You retain ownership of the content you post on the application or website, such as your Profile information, photos, messages, and other data ("User Content"). However, by posting User Content, you grant “Devotee Matrimony a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the application or website for the purpose of matchmaking and improving the application or website’s services.

You agree not to:

• Post false or misleading information.
• Post offensive, obscene, defamatory, or unlawful content.
• Use the application or website for illegal purposes, including harassment or fraud.

We reserve the right to remove or modify any User Content that violates these Terms.

5. Privacy and Data Protection

Your privacy is important to us. Please review our “Privacy Policy” to understand how we collect, use, and protect your personal data. By using the application or website, you consent to the collection and use of your data in accordance with the Privacy Policy.

6. Prohibited Activities

8. Matchmaking Services

While the application or website provides tools for users to connect and communicate, we do not guarantee that you will find a compatible partner or that the profiles provided are accurate or truthful. You are solely responsible for your interactions with other users, and we are not liable for any disputes, damages, or other issues arising from such interactions.

9. Limitation of Liability

To the maximum extent permitted by law, Devotee Matrimony, its affiliates, employees, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or other intangible losses, arising from:

• Your use or inability to use the application or website.
• Any conduct or content of third-party users of the application or website.
• Any interactions, disputes, or damages between you and other users of the application or website. Our total liability to you for any claim arising out of or related to the application or website shall not exceed the amount you have paid for the use of the application or website during the past 6 months.

10. Termination and Suspension

We may suspend or terminate your account or access to the application or website at any time, without notice, if we believe you have violated these Terms or if we are required to do so by law. You may also terminate your account at any time by contacting us.

Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the application or website. Any outstanding obligations or liabilities will survive termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless Devotee Matrimony and its affiliates, officers, directors, employees, agents, and licensors from any claim, demand, liability, loss, or expense (including legal fees) arising out of or related to your use of the application or website, your violation of these Terms, or your infringement of any rights of third parties.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Union Territory Delhi, India. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in Delhi, in accordance with the rules of Delhi International Arbitration Centre.

Information Technology Act, 2000 - Rules & Guidelines

1. Overview

In accordance with the Information Technology Act, 2000 ("IT Act"), and its amendments, we at Devotee Matrimony ("we," "our," "us") are committed to ensuring the protection and security of your personal data and ensuring compliance with all relevant provisions under the IT Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This section outlines our practices and obligations under the IT Act, 2000 and its rules.

2. User Agreement and Legal Obligations

By using Devotee Matrimony and its services, you acknowledge and agree to abide by our Terms of Service, Privacy Policy, and all applicable laws under the Information Technology Act, 2000. In particular, you understand that:

• We are an intermediary under the IT Act and do not guarantee or verify the accuracy, truthfulness, or appropriateness of any user-generated content.
• We do not take responsibility for the interactions or relationships between users of the platform. • Users are responsible for their actions and must comply with applicable laws.

3. Content and User-Generated Material

As per the Intermediary Guidelines under the IT Act, we monitor and regulate user-generated content and ensure compliance with Indian laws. Any content uploaded by users:

• Should not violate Indian laws relating to defamation, obscenity, pornography, child exploitation, or any other unlawful content.
• Should not infringe upon any intellectual property rights of third parties.

We reserve the right to take down or remove any content that is offensive, defamatory, illegal, or violates the terms of service.

4. Reasonable Security Practices for Personal Data

As an online matrimonial service provider, we take appropriate measures to protect your sensitive personal data or information (SPDI) under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

We implement the following practices:
